These Terms of Service ("Terms") govern your use of Daedalus ("the app", "the service"), operated by Mikael Høiseth (Høi Z ENK, org.nr. 924 425 407, Tamokveien 1427, 9334 Øverbygd, Norway). By creating an account or using the app, you agree to these Terms.
Daedalus is a safety and operations documentation platform for professional outdoor leaders, including mountain guides, kayak instructors, ski guides, and other outdoor educators. The app provides tools for pre-trip safety checks, incident logging, hazard mapping, and automated PDF reports intended for legal, insurance, and regulatory purposes.
You must be at least 18 years old and have the legal capacity to enter into binding agreements. By using Daedalus you confirm you are a professional outdoor leader, an organization employing such leaders, or an authorized representative of such an organization.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@daedalus-app.no if you suspect unauthorized use.
Daedalus offers two subscription plans:
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends. The price charged at renewal is the same as the price you initially agreed to, unless we have provided you with at least 30 days' written notice of a price change.
Free trial: The 14-day trial begins on subscription start. You may cancel at any time during the trial without being charged. Trials are limited to one per Apple ID (Solo) or one per organization (Organization).
Cancellation: Solo subscribers cancel via Apple ID Settings → Subscriptions. Organization subscribers cancel via the Stripe customer portal or by emailing hello@daedalus-app.no.
Refunds: Refund requests for Solo subscriptions are handled by Apple under their standard refund policy. Refund requests for Organization subscriptions are handled at our discretion in line with applicable consumer protection law.
You agree not to:
You retain ownership of all data you submit to Daedalus, including trip logs, incident reports, hazard maps, participant information, and PDF outputs ("User Content"). You grant Høi Z ENK a limited, non-exclusive license to store, process, and display User Content solely to provide the service to you.
You are solely responsible for the accuracy and legality of User Content. You confirm that you have obtained all necessary consents from any individuals named in your records, including participants and emergency contacts.
Daedalus is a documentation tool, not a substitute for professional training, certification, or judgment.
The app may integrate weather forecasts, avalanche bulletins, or other third-party data sources. Such data is provided for convenience only and may be incomplete, delayed, or inaccurate. You must independently verify all safety-critical information.
You acknowledge that:
To the maximum extent permitted by applicable law, Høi Z ENK and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, personal injury, or property damage, arising out of or relating to your use of (or inability to use) Daedalus.
Our total liability to you for any claim arising under these Terms is limited to the amount you paid for the service in the 12 months preceding the claim.
Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, intentional misconduct, or matters covered by mandatory consumer protection legislation.
We strive to keep Daedalus available at all times, but we do not guarantee uninterrupted access. The service may be unavailable due to maintenance, technical issues, or events beyond our control. We are not liable for losses caused by service unavailability, but we will use reasonable efforts to restore access promptly.
Daedalus, its source code, design, branding, and all related intellectual property are owned by Mikael Høiseth (Høi Z ENK). You receive no rights to the app's intellectual property other than the limited right to use the service in accordance with these Terms.
You may stop using Daedalus at any time by cancelling your subscription. We may suspend or terminate your account if you breach these Terms, if required by law, or if continued service would expose us to legal or financial risk. On termination, your access ends but your obligations under sections 6, 7, 8, 10, and 13 survive.
You may permanently delete your account from within the app (Profile → Delete Account). On deletion, your User Content is removed from active systems within 30 days. Anonymized backups may persist for up to 90 days for legal and operational reasons.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Norway. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the Norwegian courts, with Nord-Troms and Senja tingrett as venue of first instance, unless mandatory consumer protection law provides otherwise.
